(2) The general principle stated in subsection (1) of this
section shall not apply where provision contrary thereto is made by
this Constitution or the Supreme Court Order or any Act of
Parliament passed in accordance with this Constitution. In
particular, the general principle stated in subsection (1) of this
section shall not apply where, by this Constitution or the Supreme
Court Order or such Act of Parliament, the President is required or
authorised to act
(a) in his own deliberate judgment;
(b) in his discretion;
(c)in consultation with any person or
authority; or
(d) in accordance with the advice of any person
or authority other than a Minister or the
Cabinet.
(3) Without prejudice to any other case in which the
President is required or authorised to act in his own deliberate
judgment, the President shall act in his own deliberate judgment in
accordance with the following provisions of this Constitution-
(a)
sections 109 and 115 (1) and (3) (which
relate to the Prime Minister and other
Ministers);
sections 125 and 128 (1) (which relate to the
Minority Leader); and
section 198 (a) (which relates to the
Chairman of the Public Service Board of
Appeal).

(4) Without prejudice to any other case in which the
President is required or authorised to act in his discretion, the
President shall act in his discretion in accordance with the following
provisions of this Constitution-
(a)
section 131 (e) (which relates to certain
membersoftheParliamentary
Commission); and
(b) section 172 (1) (which relates to the
appointment of the Presidents personal
staff).
