imposed on him, questions of mercy shall be for the
exclusive determination of the President acting in
accordance with the advice of the Parliamentary
Commission pursuant to section 134 of this Constitution.
            (8) The carrying out of capital punishment in
accordance with this section shall not be held to be
inconsistent with or in contravention of this section or
section 26 of this Constitution protecting the right to life or
any other provision of this Constitution.
Protection
from
deprivation
of property.
       30. (1) No property of any description shall be
compulsorily taken possession of, and no interest in or right
over property of any description shall be compulsorily
acquired, except for a public purpose and except where
provision is made by a law applicable to that taking of
possession or acquisition for the payment, within a reasonable
time, of adequate compensation, that is, compensation which
in all the circumstances is fair and reasonable to the person
entitled to compensation and also to the State, without
limitation as to the date at which compensation should be
assessed:
            Provided that the compensation shall be paid
within twelve months of the date of the compulsory taking of
possession or acquisition.
              (2) Every person having an interest in or right
over property that is compulsorily taken possession of or whose
interest in or right over any property is compulsorily acquired
shall have a right of direct access to the High Court for -
(a)
determining the nature and extent of
that interest or right;
determining whether that taking of
possession or acquisition was duly
carried out in accordance with a law
authorising the taking of possession or
acquisition;
