or tribunal or any other body or authority is established by
or under the Constitution. Such actions, suits and other
legal proceedings may, subject to subsections (2), (3) and (4)
of this section, on or after the appointed day, be continued
and completed by or before such corresponding court of
law, or tribunal or other body or authority as if they had
been commenced in or before such corresponding court of
law, or tribunal or other body or authority.
(2) This subsection refers to proceedings
before any court of law or tribunal where the hearing was
partly completed immediately before the appointed day (in
this subsection referred to as the original hearing). No
person shall take part in the continued hearing, either as the sole
or other member, as the case may be, of the corresponding court
of law or tribunal, referred to in subsection (1) of this section,
unless he also likewise took part in the original hearing. Where
the original hearing cannot be so continued, the hearing shall be
recommenced.
(3) Any criminal proceedings pending in any
court immediately before the appointed day, in which Her
Majesty the Queen is a party in respect of Saint Vincent and the
Grenadines, may be continued on or after that day with the
substitution of the State in place of Her Majesty as a party.
(4) Any action, suit or other proceedings
pending in any court immediately before the appointed day, in
which the Governor-General is a party, may be continued on or
after that day with the substitution of the President in place of
the Governor-General as a party.
Succession to property.
9.(1) All property which, immediately before the
appointed day, is vested in Her Majesty the Queen or the
Governor-General for the purposes of the Government of Saint
Vincent and the Grenadines shall, on the appointed day, vest in
the State.
